Envelopes must be closed & sealed properly with any sealing material. (vi)This tender schedule is to be submitted duly signed in each page with tender as a token of acceptance. Contd. P/2 Page-2 RATE3) (i) Rates should be quoted only in the prescribed Tender Form & in both Words & Figures. In case of discrepancy between words & figures the amount in word will prevail. In case of insufficient space in the Tender Form the Bidder may use a separate sheet duly authenticated by them. Rates of each item should be written distinctly and clearly. (ii) The Rate should be inclusive of all charges, such as delivery, loading, unloading, stacking, cost of transportation, Insurance etc. Taxes & leviable duties should be quoted separately wherever applicable. (iii) Erasures, interpolation, changes, addition or alteration in Rates of any item may be treated as cancelled unless authenticated by hand and seal of the Bidder. Rates quoted which are not as per specification mentioned in the Tender/Catalogue will not be accepted. (iv) Rates should be quoted in units mentioned in the Tender Notification/Catalogue. Single Rate for each item should be quoted for entire quantity. Tender with split rate and quantity for a particular Farm will be rejected. (v) Under no circumstances enhancement of rate whatsoever will be accepted after closing of tender box, whatever the reasons given thereafter save & except for any tax imposed by the Government. Photocopy of Govt. Order in this respect is to be submitted while claiming such increase. If there is no Excise Duty whatsoever, after submission of Tender it will not be allowed. (vi) Only Rates of items will be read out by the officers of this Directorate at the time of opening of the tender. (vii) Abnormally low rate of any item(s) quoted by a tendering firm in the offer with some malafide intention will not be accepted, if detected. (viii) The authority does not guarantee purchase of invited quantity as order since it depends upon the actual requirement evaluated by the farm authority. Hence rate should be quoted accordingly. VALIDITY4) (i) Rates quoted shall hold good for Six Months from the date of approval of Rate by the Tendering Authority and/or any extended period, if situation arises and within the validity period, any further requirement other than tendered quantity must be supplied at the approved rate during the validity of tender and refusal to supply will be dealt with as per tender rule. (ii) The validity period of rate may further be extended/curtailed at the discretion of the undersigned /Tendering Authority/ Tender Committee at the time of finalisation of tender or after expiry of the period of validity. SAMPLE/ LITERATURE4) (i) Sample & Literature of the offered item must be produced to the Store Keeper, Transit Stores, Block-A (beside lift), Ground Floor, Writers Bldgs., Kol-1 in the prescribed manner as described in clause No. 4(ii). (ii) 1(One) Kg. (approximate) sealed samples of the offered item/kept in a poly jar of cylindrical (transparent) shape, length: 63 (approx.), Base Diameter: 3.53 (approx.)& colour of the lid should be RED must be produced at the Transit Stores, Block-A, Ground Floor, Writers Buildings, Kol-1 before opening of tenders for organolaptic test/physical verification. No sample will be accepted, if the same does not comport to the specification of the container described sealed sample shall be submitted with a label showing (i) Name & Address; (ii) Tender No. & (iii) Commodity. In case of damage/breakage the Tendering Firm shall submit another sample on demand. (iii) In case, sample/literature is approved, one set of such sample/literature shall have to be kept in sealed condition with this Dte. during the tenure of tender. Supplies should be made according to the approved sample & literature. Only valid Bidders sample will be examined. In case of unapproved sample, the same may be returned after due procedure. However, if samples are consumed during analysis those may not be returned. (iv) The sample/s will be sent for Organolaptic Test/Physical Verification provided that tender/s of sample producing firm is valid in respect of submission of tender pre-requisites mentioned in Clause No.1 & 2 above. Contd. P/3 Page-3 (v) Unapproved sample(s) will have to be taken back by the bidder within one month from the date of submission of sample. The authority/Govt. will not take any responsibility/liability for any loss/damage for those samples beyond that period. (vi) Inspection of materials may be undertaken at the suppliers premises whenever necessary by the Tendering Authority/any officer authorised by the undersigned. (vii) In the event of non-submission of sample/literature, it will be treated as unwillingness/inability to supply & such tender will not be considered. AGREEMENT5) (i) The Successful Bidder will have to enter into a contractual agreement with the Government in the standard format embodying the tender terms & conditions in Non-Judicial Stamp Paper worth Rs.10/-(Rupees Ten) only. (ii) The Contract period may be extended or curtailed by the Tendering Authority, if situation arises. SECURITY MONEY DEPOSIT6) (i) The Successful Bidder will have to deposit Security Money @ 5% (five percent) ad-valorem subject to maximum of Rs.1,00,000/- (Rupees One Lakh) only in Term/Fixed Deposit Receipt on any Nationalized Bank in favour of the respective Head of the Farm, A/c.: ______________(Name of the Firm) within 7(seven) working days from the date of issue of order failing which the order will be cancelled along with forfeiture of Earnest Money Deposit kept at Head Quarters and no further correspondence will be entertained. Security Money should be deposited for each item and for each farm separately. Partial Deposit/adjustment with previous deposit(s) will not be accepted. Tendering Firm may deposit security money @ 3% by adjusting 2% earnest money deposited for same item and same tender only. (ii) The Security Money may carry interest. This Directorate is not liable for deposition of excess S. Money. (iii) Security Money will be refunded after satisfactory completion of supply. No proportionate refund of Security Money will be allowed if the supplied quantity either falls below the ordered quantity or below the prescribed tolerance limit. SUPPLY/ DELIVERY7) (i) Delivery will be made strictly as per given schedule as printed in the order. The schedule may revised (increased/decreased/temporarily postponed)by the receiving authority, depending upon season & demand. (ii) The requirement/quantity normally depends upon the actual requirements of the State Farm(s). The successful firm is required to supply any quantity at the accepted rate within the contracted period. (iii) The ordered item must be packed suitably to avoid transit loss & weathering to maintain quality. No torn bags of any ingredients will be received. The supply must comport to the given specification in the tender. (iv) Supply must be commenced within 7 (seven) working days from the date of placement of formal order or the date as specified in the order. (v) The gross weight(weight of the material +empty weight of the truck)should not exceed 18(eighteen)M.T. (vi) @ 5% (five percent) less or excess the ordered quantity will be accepted. (vii) Supply will normally be accepted on all working days between 11 am. & 3 pm. Successful bidder must provide the requisite number of labour to weigh the materials in the respective store as will be indicated from time to time without any additional charges. No supply will be accepted on Sundays & Govt. Holidays unless otherwise desired by the receiving authority. (viii) IT IS OBLIGATORY FOR THE BIDDER TO NOTE THAT FAILURE TO MAINTAIN DELIVERY SCHEDULE FOR SUPPLLY OF FEED INGREDIENT WILL LEAD TO SEVERE DISLOCATION IN PREPARATION OF COMPOUND FEED AND STARVATION OF ANIMALS FOR WHICH SUCCESSFUL TENDERER WILL BE HELD RESPONSIBLE AND ACTION WILL BE TAKEN STRICTLY AS PER TENDER RULES LAID DOWN HEREIN WITHOUT ANY PREJUDICE, ANY SORT OF PLEA WILL NOT BE CONSIDERED, SAVE & EXCEPT ANY INCIDENT OCCURRED BY ACT OF GOD MAY BE CONSIDERED SYMPATHETICALLY. Contd. P/4 Page-4 ORGANOLAPTIC TEST/ CHEMICAL ANALYSIS8) (i) The supplier will have to make delivery of the materials in such a way that sample can be drawn even from the bottom layer of bags for organolaptic test/physical verification & for this purpose some bags are to be unloaded and reloaded that should be done by the supplier at his own cost. (ii) If in organolaptic test/physical verification, any consignment is found to be inferior in quality if even a small percentage of sample drawn fails to come up to the standard of the submitted sample, the authority will reject the consignment outright. In such cases of outright rejection, no sampling will be done & the rejected consignment will have to be taken back by the firm at their own cost immediately after rejection. If not done so, the rejected consignment will be kept in the open air and the authority will not take any responsibility or will be liable for any loss or damage of such stock. In such cases, replacement must be done within 15 (Fifteen) days from the date of intimation. (iii) When a consignment has been provisionally accepted after the aforementioned tests, four samples will be drawn and sealed in presence of the firms representative for chemical analysis. One such sealed sample packet will be handed over to the firms representative, the second one will be sent for proximate analysis from own laboratory while third/fourth sample packet will be kept in our safe custody for future use if so required. All four sealed samples are to be signed by the officers as well as the Firms representative. (iv) Chemical Analysis will ONLY be carried out at our own laboratory. Objection from the tendering firm in this regard & time taken for such analysis will not be entertained in any case. The tendering firm will be bound to accept the result of analysis obtained by this Directorate. The decision of the competent authority regarding analysis of ingredient is final and binding to the supplier. PENAL MEASURES8) (i) The Earnest Money Deposit furnished by a firm will be liable to be forfeited in full(including excess amount of earnest money, if deposited), if the firm withdraws his tender as a whole or for any particular item at any stage during the tenure of tender or fails/refuses to enter into written agreement once the rate for any/all items is/are accepted within the time specified when requested to do so by this Directorate and/or refuses to deposit Security Money. Such firms offer will not be taken into consideration in future & shall liable to be black listed for 3(three) years. (ii) The Security Money Deposit furnished by a Bidder is liable for forfeiture in full (including excess amount of Security Money, if deposited)along with cancellation of order without prejudice in the event of failure/refusal to maintain the given delivery schedule and/or non-observance of terms & conditions of tender and/or contracted specification and/or quality/quantity and terminate the contract as a whole or part. (iii) The price, at which the tendering firm sells the products of identical description to any other Govt. Directorate, Organization, etc. shall not exceed the quoted rate. If such incident of quoting higher rate comes to the notice the authority reserves the right to initiate legal/penal action against such firms. (iv) In the event of failure of delivery schedule of consecutive two consignments, the supplier will be penalised by deducting 20% amount of security money from the outstanding bills and so on. (v) In case the delivery programme is not followed and the competent authority is compelled to procure the ordered articles from the open market at a higher rate than the accepted price in tender, in that case the excess cost incurred on the account will have to be borne by the firm which will be deducted from their outstanding bill apart from forfeiture of Security Money Deposit in full. Besides, failure to maintain the delivery schedule /stoppage of supply may lead to termination of contract along with forfeiture of Security Money Deposit in full and such firms shall liable to be BLACK LISTED FOR 3 (THREE) YEARS. (vi) If after chemical analysis, when any consignment is found to be non-acceptable quality even after deduction as mentioned in clause (9) below, the same may be rejected. The rejected material will have to be taken back by the supplier at h is own cost within 15(fifteen) days of receipt of information, thereafter, the supplier will have to pay Shed Rent @ Re.1.00 (One Rupee) only per day per bag. PRO- RATA DEDUCTION9) Pro-rata deduction will be made in the following manner in case of deviation in specification :- (i) Percent to percent up to 3% from the minimum/maximum limit to the specification. (ii) Beyond 3%, deduction will be made @ 2% from every 1% deviation up to limit of further 2% from the specification. Contd. P/5 Page-5 (iii) Further deviation{(i) + (ii)}from the maximum/minimum limit of the specification deduction will be made @ 3% for every 1% deviation or the material will be rejected. (iv) Summation of deviated parameters beyond 10(ten)% & above the consignment will be rejected straightway except in the case of Maize & Jower (in whole grain). (v) In case of Maize/Jower (in whole grain)-Parameter of the Moisture would be allowed up to 10% as standard specification & another 3% Maximum as deviation beyond which materials would be rejected. PAYMENT10) (i) Bills of Cost against all supplies is/are to be sent in TRIPLICATE in favor of the Assistant Director, Animal Resources Development (Accounts) of the farm and should invariably be submitted along with supplies. (ii) Payment shall be made after executing the order satisfactorily in all respect. However, no interest shall be paid to the firm, if the payment is delayed due to whatsoever reasons. In no circumstances, delivery schedule should be affected and or linked with the payment of outstanding bills. This is important to note that the supplies are directly linked with animal ration. The payment of bills shall be withheld, in case of violation of any tender terms & conditions. MISCELLANEOUS11) (i) No Tender/ Tender Pre-Requisites such as Earnest Money Deposit, Trade License, etc. will be accepted after closing Tender Box strictly. (ii) Conditional Tenders and Tenders not accompanied with the documents as mentioned in Clause No.1) & 2) shall be summarily rejected without any reference made to the Bidder & no correspondence will be entertained. (iii) In case of products with Brand Name, the Tendering Firm is required to mention the Brand Name against each item. In case, I.S.I. marked products, the Tendering Firm shall have to produce License of manufacturing from B.I.S. (vi) If the submission & opening of tender is not possible on the scheduled date & time due to any unavoidable circumstances, the same will be done on immediate next working day at the same time prescribed in the tender. The bidder shall not be informed separately in this regard. (vii) The offer may go to the next bidder, if the successful bidder fails to perform the contract. (viii) No negotiation/enquiry/subsequent representation regarding rate/quantity/quality or otherwise will entertained after closing of Tender Box. (ix) No Import License, any sort of permit, etc. in respect of any item will be provided from this Directorate and the tendering firm should have to rely on their own resources. (x) Latest guidelines pertaining to purchase of stores issued by Government of West Bengal will be followed provided that there is no specific instruction of the Tender Committee in this regard. (xi) The undersigned reserved the right to reject any or all of the tenders at any stage without assigning any reason thereof & will not be bound to accept lowest tender rate. (xii) Any dispute/difference arising out of this Tender will be referred to the sole arbitrator to be appointed by the undersigned and the same will be held at Kolkata. Arbitrator will have the power to pass interim order and will be guided by the Arbitration & Conciliation Act, 1996. (xiii) When a Tendering Firm submits his tender in response to this Notification, he will be deemed to have understood fully the contents, the requirements, terms & conditions of this Tender. No extra Payment will be made on the pretext that the Tendering Firm did not have a clear idea of any particular point. Any offer made in response to the tender when accepted by the Tendering Authority will constitute a Contract between the parties.
